1. General
Werk3 Studiovermietung GmbH provides its services exclusively based on the following terms and conditions. Any differing terms of the client shall not apply unless explicitly confirmed in writing.
Bookings, prices and options are only binding once confirmed in writing by Werk3 Studiovermietung GmbH. Booking options may be released at any time; option holders will be granted a 24-hour period to confirm a booking.
2. Use of Studio, Equipment & Props
The client rents the studio spaces, furniture, props and/or technical equipment listed in the booking confirmation for the agreed period.
All rented items must be returned in their original condition at the end of the rental period.
3. Client Liability
Liability for all rented items transfers to the client upon handover. This includes loss, damage and transport-related damage, even if transport is arranged by Werk3 Studiovermietung GmbH.
The client is liable for all material and personal damage occurring during the rental period. Lost or damaged items will be charged at replacement or repair cost plus transport fees.
4. Liability of Werk3 Studiovermietung GmbH
Werk3 Studiovermietung GmbH is liable only for damages caused by intent or gross negligence. Liability is limited to twice the agreed daily rental fee per incident. Any further liability is excluded.
Claims must be made within six months after the end of the contractual relationship.
5. Rental Fees
The applicable prices are those listed on our website unless otherwise agreed in writing. The rental fee covers studio space only; equipment, furniture, props and additional services are charged separately.
A day rental includes 10 hours. Each additional hour is charged at 15% of the daily rate. All measurements stated on the website are non-binding; cancellations based on measurements are excluded.
6. Payment Terms
Werk3 Studiovermietung GmbH may require advance payment for new clients. All invoices are payable immediately without deduction and subject to statutory VAT (currently 19%).
7. Cancellations
Cancellations up to 7 calendar days before production start will be charged at 50% of the agreed rental fee. Cancellations from 6 days before production start will be charged at 100%.
This also applies to additional booked services such as equipment, props, set construction and catering.
8. Jurisdiction
German law applies. Place of jurisdiction and fulfillment is Munich.
9. Severability
Should any provision of these terms be invalid, the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid one closest to the intended purpose.
